These are the most important tips for investors purchasing in Brazil:
- Is the company you are purchasing from registered and operational in Brazil? This is important when dealing with the normal day to day issues.
- Do they own the project they are promoting? Or are they a third party seller.
- It is a must that you request all due diligence related to the project the land i.e. land proof of ownership, and relevant consents and planning permissions.
- Ask for the commencement/delivery date of the project this will be found in your sale/purchase agreement, if neither are there it is likely there is a problem!
- Request the developer/seller provides their terms & conditions of purchase. I.e. payment terms, security of investment etc. This should also be included in the purchase contract
- Use only a well known and respected Brazilian Lawyer locally, they will have a wealth of knowledge and this will make the purchase a smooth process, very often they will know personally the people in the chain, i.e deeds registration, fiscal matters,
- Whoever you choose to buy from developer or sales agent please ask for references and track record.
